The Kanifing Magistrates’ Court has convicted a Nigerian national, Oladema Francis, for stealing iron rods and agro-jacks valued at D80,000.
The case was presided over by Principal Magistrate Sallah M’bai and Chief Inspector E. Fatty appeared for the state, while the accused faced the charge without legal representation.
Francis was charged with theft under Section 226 of the Criminal Offences Act, 2025.
According to the prosecution, the incident occurred on 20 November 2025 at the Julbrew premises in Kanifing. The court heard that Francis, who was on duty as a security guard, stole 71 pieces of iron rods valued at D10,000 and 20 agro-jacks valued at D70,000, all properties of Assem Ahmed.
When the charge was read, Francis pleaded guilty, telling the court he stole the items because he was dealing with a “family issue” in Nigeria.
Sub-Inspector Fatty told the court that Francis contacted a scrap metal dealer and arranged for the items to be collected. The dealer arrived with a tricycle and the materials were loaded. But as they attempted to leave the premises, they were confronted by a man identified as Ali Muhammad, who questioned the movement of the goods and ordered that they be offloaded. The owner was contacted immediately, leading to Francis’s arrest.
Fatty said the accused confessed at the police station and his cautionary and voluntary statements were tendered in evidence. In court, Francis confirmed the prosecution’s account and begged for leniency, explaining that his wife had died during childbirth in Nigeria.
Delivering judgment, Magistrate M’bai noted the accused’s early guilty plea and remorse but stressed that the offence involved a breach of trust. “Offenders who commit such acts must be punished to protect society,” she said, adding that the convict was entrusted with security but violated that trust.
Francis was fined D50,000, and in default sentenced to one month imprisonment.
