The Brikama Magistrates’ Court has convicted and sentenced two young men to prison after finding them guilty of conspiracy to commit a felony, impersonation and stealing, while acquitting four other accused persons.
Delivering judgment on Tuesday, 21 July 2026, Magistrate M. Dem convicted the first accused, Bubacarr Touray, and the second accused, Alagie Tunkara, on all three counts before the court. The magistrate, however, discharged the remaining four accused persons, Lamin Ngum, Momodou Dukureh, Almamo Conteh and Momodou Sanyang.
According to the judgment, Touray and Tunkara were convicted on the first count of conspiracy to commit a felony and each sentenced to two years’ imprisonment. On the second count of impersonation, the two men were each sentenced to six months’ imprisonment. On the third count of stealing, the court sentenced both men to four years’ imprisonment.
Magistrate Dem also ordered the two convicts to pay a fine of D125,000 as compensation to the victims. The court ruled that failure to pay the amount would attract an additional nine months’ imprisonment. The six accused persons had been jointly charged with three offences.
The first count alleged conspiracy to commit a felony, contrary to Section 368 of the Criminal Code, Cap. 10:01, Volume III, Laws of The Gambia.
According to the particulars of the offence, Bubacarr Touray, Alagie Tunkara, Lamin Ngum, Momodou Dukureh, Almamo Conteh and Momodou Sanyang allegedly conspired among themselves to commit a felony within the West Coast Region sometime in 2022.
The second count alleged impersonation, contrary to Section 352 of the Criminal Code, Cap. 10, Volume III, Revised Laws of The Gambia 2009.
The prosecution alleged that the accused, with intent to defraud, falsely represented themselves as police officers, knowing that the representation was false.
On the third count, the six accused were charged with stealing, contrary to Section 252 of the Criminal Code, Cap. 10, Volume III, Revised Laws of The Gambia 2009. According to the particulars of the charge, the accused allegedly stole D238,100 from Momodou Bailo Jallow, Sulayman Barry, Samba Bah, Essa Jallow, Naji Sadler, Ali Diko, Mamadou Yorro Jallow and Mamadou Jambaliou in the West Coast Region sometime in 2022.
The prosecution alleged that the money belonged to the named complainants. Judgment was delivered in the presence of the police prosecutor, DSP Buteh Sawaneh, the accused persons and the complainants.
