Justice Jaiteh Orders For Verbatim Transcript as Ousainou Bojang’s Case Resumes

Justice Ebrima Jaiteh Tuesday, ordered court transcribers to produce a strictly word-for-word transcript in the ongoing trial of Ousainou Bojang and his sister, Amie Bojang, emphasizing that no names or details not present in the original audio should be added.

During yesterday’s session at the High Court of The Gambia, the court examined a transcribed audio recording between a witness, known as Mama Jabbie, and the first accused, Ousainou Bojang.

State Counsel A.M. Yusouf raised concerns that the transcript incorrectly included the names “Mama Jabbie” and “Ousainou Bojang,” even though they were not mentioned in the audio. He also pointed out sections of the recording that were unclear but not properly marked.

Defence counsel Jarra Jeng argued that the audio made it clear that Mama Jabbie was speaking to Ousainou Bojang, as his name was mentioned several times during the recording. Counsel A. Sillah for Amie Bojang noted that the witness had already clarified that the widely circulated audio captured a conversation between Mama Jabbie and Ousainou Bojang.

Justice Jaiteh sided with the state counsel’s objection, stressing that names cannot be attributed in a transcript without clear evidence. “The court relies on evidence, not assumptions,” he said, questioning why names were inserted when they were not in the audio.

The judge instructed the registrar to return the transcript to the transcribers for revision, emphasizing that it must reflect the audio exactly, without additions or subtractions. “The transcribers’ role is to record exactly what is on the audio, word-for-word, and leave it as it is,” Justice Jaiteh highlighted.

The case was adjourned to 2 December 2025 for the continuation of testimony from DW12.
