The High Court in Banjul has dismissed a no-case submission filed on behalf of Abdoulie Sanyang, ordering him to open his defence on two criminal charges, including arson and interference with judicial proceedings.
Justice Jaiteh, delivering the ruling, held that the prosecution had established a prima facie case requiring the accused to respond.
Sanyang is charged with arson, contrary to Section 305(a) of the Criminal Offences Act 2025, for allegedly procuring the burning of the APRC Bureau. He also faces a count of interference with pending judicial proceedings, under Section 99(d) and (i), for comments made during a live broadcast on West Coast Radio’s Coffee Time programme, in which he allegedly described the courts as “clandestine” and commented on the ongoing case of The State v. Ousainou Bojang. He has pleaded not guilty.
The prosecution called six witnesses and one subpoenaed witness, tendering several exhibits, including audio and video recordings of the interview. A media officer, Therese Fatou Gomez, authenticated the broadcast audio, while IT specialist Paul S. F. Sambou tendered a flash drive containing the video footage. Police officer Mbaye Conteh also tendered Sanyang’s voluntary and cautionary statements.
Justice Jaiteh noted that Exhibit P7, a key video tendered by the prosecution, captured the accused stating that he paid individuals to burn the APRC Bureau—conduct the court said amounts to procurement of the alleged offence under Section 26(1)(d).
On the second count, the court found that the recordings clearly captured statements capable of misrepresenting judicial processes and undermining public confidence in the administration of justice.
Citing Section 245 of the Criminal Procedure Act 2025, the judge said an acquittal at this stage is only permissible where the prosecution has failed to make out a case requiring an answer. He ruled that the testimony and exhibits presented were credible and probative.
The court therefore overruled the no-case submission and ordered Sanyang to enter his defence.
