Former Auditor General’s Civil Suit Resumes Before Supreme Court

The Supreme Court of The Gambia has allowed the state to file a rejoinder in a civil lawsuit filed by the former Auditor General against the government.

The ruling was delivered on Monday by Chief Justice Hassan B. Jallow as the case resumed.

The case, originally filed on 3 October 2025, was accompanied by a statement of case from the plaintiff. When the matter first came before a single Supreme Court judge, the two defendants—the Attorney General and the Inspector General of Police were ordered to file their statements of case within 21 days. The plaintiff’s lawyer, Lamin J. Darbo, was directed to file a reply within seven days.

The defendants had raised a preliminary objection, arguing that the lawsuit did not comply with Supreme Court procedures and was therefore irrelevant and incompetent.

The Solicitor General, Hussusin Thomasi, representing the state, also requested that the suit be struck out.

Chief Justice Jallow, however, ruled that the preliminary objection was inadmissible and dismissed it, noting that the absence of specific provisions in the court rules does not prevent the Supreme Court from issuing orders necessary to ensure due process and a fair hearing.

The Chief Justice further stated that, given the lengthy and detailed reply submitted by the plaintiff, the court considered it appropriate for the defendants to be allowed an opportunity to file a rejoinder.
