Age Dispute Halts Trial of Two Boys At Brikama Court

Magistrate K.B. Sambou of Brikama Magistrates’ Court on Thursday, 16th October, adjourned the case of two boys who claimed to be 17 years old, for the court to advise itself on how to proceed.

First Class 7679 S. Sonko appeared for the Inspector General of Police, while the two accused persons, Modou Lamin Joof and Sulayman Joof, were unrepresented.

Before the charge sheet was read, Magistrate Sambou asked both accused their ages. They each responded that they were 17. However, Police Prosecutor Sgt. Sallah told the court that police records indicate that the first accused, Modou Lamin Joof, is 20 years old.

The mother of the first accused, who was present in court, maintained that her son is 17.

Magistrate Sambou noted that, based on their statements, both accused are minors, and the court therefore cannot proceed without legal direction. “I hereby adjourn the case to the 19th of November 2025 for the court to advise itself,” he said.

The magistrate granted both accused bail in the sum of D50,000 each, with one Gambian surety per accused. Each surety is required to deposit a valid ID card or passport with the court registrar and swear to an affidavit of means.

The two are charged with attempt to commit a felony, contrary to Section 339 of the Criminal Offences Act 2025.

According to the particulars of offence, on or about the 13th of October 2025, at Brikama in the West Coast Region, the accused allegedly entered the compound of Alagie Baba Sonko with intent to steal, thereby committing an offence.
