Brikama Magistrates’ Court on Tuesday convicted and sentenced Omar Barrow to pay a fine of twenty-five thousand dalasis (D25,000.00) in default to serve imprisonment after finding him guilty of theft.
Barrow was said to have stolen twenty thousand dalasis (D20,000.00) from Basiru Njie, a serving member of the Gambia National Army (GNA).
The accused appeared unrepresented before the court, facing charges under Section 252 of the Criminal Code for the offence committed on 4th October 2023 at Lamin, West Coast Region. When the charge sheet was read, Barrow pleaded not guilty.
The prosecution, led by Chief Inspector Colley, who represented the Inspector General of Police, called three witnesses: Basiru Njie, Sheriff Tamba, and Jean Chore. Their testimonies outlined the circumstances of the theft and traced the stolen funds to the accused.
In delivering the judgment, Magistrate K.B. Sambou said, “Based on the totality of the evidence before this court, I am strongly satisfied that the prosecution has proved its case beyond a reasonable doubt. The accused is therefore found guilty.”
When allowed to present mitigation, Barrow informed the court that he had nothing to ask for mercy. Despite this, the Magistrate considered him a first-time offender and exercised judicial discretion.
Barrow was ordered to pay a D25,000 fine, in default of which he would serve three months in prison. Additionally, he must repay the stolen D20,000 to Njie, failing which he faces six months imprisonment. Both sentences are to run concurrently.
Magistrate Sambou emphasized that the theft could have caused serious disruption to the complainant’s professional duties, but noted that exercising mercy on a first-time offender was appropriate.
