Lamin J. Darboe, the lawyer defending ex-military officer, Abdoulie Sanyang Thursday filed a bail application at Banjul High Court seeking the release of his client on health grounds.
During court proceeding yesterday, Lawyer Darboe urged the presiding judge, Justice Ebrima Jaiteh to grant his client “unconditional bail,” citing health concerns that, he said, required Sanyang to travel to Switzerland for medical treatment.
To back up his claim, the defense counsel further relies on Section 125 of the Criminal Procedure Act, 2025, which provides for court bail to be granted to an accused person charged with a capital or serious offence under “exceptional circumstances.”
Counsel Darboe also told the court that Superintendent Yusupha Jabang, officer-in-charge of the Mile Two Clinic, had confirmed his client’s illness.
However, at that point, State Counsel Saikou Lamin Jobarteh opposed the application, questioning the professional qualification of Superintendent Jabang to issue a medical opinion on the accused’s condition.
Jobarteh urged the court to summon Chief Superintendent Jabang to testify regarding his medical credentials.
Then, the presiding judge, Justice Jaiteh ordered Defense Counsel Darboe to regularize his bail application.
Meanwhile, Defense Counsel Darboe sought an adjournment to enable him obtain a medical certificate from a duly qualified medical practitioner employed in a government hospital, as required under Section 125 of the Criminal Procedure Act, 2025.
Justice Jaiteh granted the request and adjourned the matter to October 14, 2025 for continuation of hearing.
