Justice Ebrima Jaiteh of the Banjul High Court has directed the Ministry of Interior to ensure remand prisoners are brought before the courts without undue delay, citing logistical challenges affecting judicial proceedings.
The directive follows repeated delays caused by a shortage of escort officers, which has disrupted court schedules. A prison officer told the court they had to rely on sports personnel to assist with escort duties.
Justice Jaiteh said the issue stems from “the unavailability of a sufficient number of male prison officers to escort and supervise remand prisoners,” adding that it undermines the constitutional right to a fair hearing.
He instructed the Interior Minister and Inspector General of Police to take immediate steps, including assessing staffing levels and improving transport arrangements.
“Non-compliance with these directives will not only undermine judicial efficiency but may also amount to a violation of the fundamental rights of detained persons under the Constitution,” he warned.
