Judge Demands Medical Report To Support Ex-Soldier Sanyang’s Bail Application

The High Court of The Gambia has directed the Edward Francis Small Teaching Hospital (EFSTH) to conduct a thorough medical examination on Abdoulie Sanyang, the former soldier who is facing charges of arson and judicial interference, as part of his bail application process.

The presiding judge, Justice Ebrima Jaiteh made the demand and ordering for the medical report before he could determine Sanyang’s application for bail. It could be recalled that Sanyang’s lawyer had made bail application to enable his client to travel abroad on medical grounds.

Pursuant to the court’s orders of 13 October 2025, the Chief Medical Director of EFSTH was instructed to carry out a comprehensive medical assessment of Sanyang and submit a detailed medical report to the court by Monday, 20 October 2025, at 1:00 p.m.

However, the court received a letter from EFSTH on 20 October 2025, signed by Mr. Samba Bah on behalf of the Director of Administration and Human Resources, acknowledging the court’s order but stating that the medical report could not be completed as scheduled due to logistical challenges. The hospital assured the court that the report would be submitted as soon as possible.

Justice Jaiteh emphasized that under Section 125(1) and (2)(a) of the New Criminal Procedure Act, 2025, government hospitals are required to provide certified medical reports to support bail applications based on ill health. The law specifies that a person charged with an offence punishable by life imprisonment may only be granted bail under “exceptional circumstances,” including verified ill-health that cannot be adequately treated within the detention facility.

The judge noted that EFSTH’s acknowledgment of the order without a definite submission date fell short of full compliance. Justice Jaiteh therefore ordered the Chief Medical Director to provide a clear date for when the medical report will be ready.

The report must also state whether Mile II Central Prisons has adequate facilities to manage and treat Sanyang’s medical condition while in detention. Additionally, the medical practitioner who conducts the examination is required to appear in court on the next adjourned date to formally present and explain the findings.

The case has been adjourned to 28 October 2025 at 11:30 a.m. for the submission of the medical report.
