Brikama Magistrates’ Court Fines Gunjur Resident D15,000 for Criminal Trespass and Theft

A resident of Gunjur, Ebou Jobe, was on Thursday, 9th October 2025, convicted and sentenced by Magistrate K.B. Sambou of the Brikama Magistrates’ Court after pleading guilty to two counts of criminal trespass and stealing.

Cadet Inspector A. Kanyi appeared for the Inspector General of Police, while the accused was unrepresented.

On the first count, Jobe was charged with criminal trespass contrary to Section 262 of the Criminal Offences Act 2025. The particulars of the offence stated that on 6th October 2025, at Gunjur in the West Coast Region, he unlawfully entered the compound of Seobo Idrisu with the intent to intimidate, insult, or annoy, thereby committing an offence.

On the second count, he was charged with stealing contrary to Section 226 of the same Act. The prosecution alleged that on 8th October 2025, at Gunjur, Jobe stole a wheelbarrow valued at D3,000 and metallic rings worth D1,500, both belonging to Seobo Idrisu.

The charges were read and explained to the accused in English and interpreted in Wolof, which he understood. He pleaded guilty to both counts.

Narrating the facts, Prosecutor Kanyi told the court that the accused went to the Gunjur riverside to fetch firewood and, on his way back, unlawfully entered the complainant’s compound where he saw and took the wheelbarrow and metallic rings. The complainant’s wife saw him leaving the compound and reported the matter to the police, leading to his arrest and charge.

The prosecution tendered the cautionary and voluntary statements of the accused, as well as photographs of the stolen items, all of which were admitted into evidence and marked as exhibits A1, A2, B1, and B2.

In his mitigation plea, the accused expressed remorse, saying, “I regret why I did it.”

Magistrate Sambou sentenced Jobe to pay a fine of D5,000 or serve six months imprisonment on the first count, and D10,000 or one year imprisonment on the second count. The sentences are to run concurrently.
