Man Convicted for Damaging Mobile Phone

The Kanifing Magistrates’ Court presided over by Magistrate Binta Sowe, yesterday convicted one Babucarr Mbye for unlawfully damaging a mobile phone belonging to his ex-girlfriend.

Mbye was charged with malicious injury to property contrary to section 290 of the Criminal Code, 2025.

According to the particulars of the offence, the incident occurred on 23rd October 2025 at the Serekunda BS Garage in the Kanifing Municipality, where the accused unlawfully damaged a Techno Spark 20 mobile phone valued at D8,000, property of Chioma Chinedu.

When the charge was read out in court, the accused “pleaded guilty” as charged.

In narrating the facts, Sergeant 4195 Amadou Baldeh, who appeared for the Inspector General of Police, told the court that the victim was on her way to meet someone when the incident occurred around 3:00 a.m.

He said the convict approached the victim from behind and grabbed her phone while she was on a call. When the victim turned to confront him, the convict claimed she owed him D20,000, which she denied. A struggle ensued, during which the phone was damaged.

 

A neighbour, Sajar Sanneh, who heard the commotion, intervened and recovered the damaged phone from the accused. Sanneh later escorted both parties to the police station.

At the station, the complainant informed the police that the convict was her former boyfriend, who had been threatening her since their breakup a matter she had previously reported.

The damaged phone, valued at D8,000, was tendered in court as Exhibit A1 and admitted into evidence.

When asked for mitigation, Mbye pleaded for leniency, saying:

“I’m very sorry. If the court permits, I can fix the phone. It was a mistake, and I’m asking the court to forgive me.”

Prosecutor Baldeh applied under section 191 of the Criminal Procedure Code 2025 for compensation to be awarded to the victim.

In her ruling, Magistrate Sowe noted that the accused did not waste the court’s time and accordingly sentenced him to pay a fine of D5,000, in default to serve three months’ imprisonment, and a compensation of D15,000 to the victim, in default to serve one year imprisonment at Mile II Central Prison.

Both sentences are to run consecutively.
