Yahya Jammeh loyalists under the banner of APRC No-To-Alliance have challenged the legality of the Truth Reconciliation and Reparations Commission (TRRC) and the Janneh Commission, while calling for the peaceful return of their party leader to the Gambia.
This was contained in a position paper presented by Jammeh loyalists to the Gambian Government and the National Assembly.
In a letter that is reported to have been signed by Momodou Yafaye Tamba, senior member of APRC No-To-Alliance, also official spokesperson for former President Jammeh, strongly references Jammeh’s constitutional rights as a citizen and his commitment to peace and national stability.
“The authorities and the Gambian people are hereby gently reminded that neither the Truth, Reconciliation and Reparations Commission (TRRC) nor the Janneh Commission is under the laws of The Gambia and courts of law. Furthermore, by their own acts and omissions, these bodies and/or their resultant white papers are considered null and void in law,” Tamba wrote. “Therefore, they neither impede nor impinge on the rights and privileges of H.E. Former President Jammeh as a citizen, a political leader, and a former president and head of state,” Tamba added.
The position paper further explained that former president Jammeh left the shores of The Gambia on 22nd January 2017 to maintain peace, national unity and stability and that he was still committed to peace and national cohesion and proposed peaceful return home with the undertone of faith and patriotism, and strongly based its argument on a said Joint Agreement on 21st January 2017 between former President Jammeh and ECOWAS, AU and UN which linked to Gambia’s national constitution that guarantees his liberty to return to The Gambia at any time he chooses.
The position paper respectfully seeks the cooperation, understanding, and proactive engagement of all relevant institutions and international partners for immediate consideration of constitutional provisions and other laws of Gambia, which guarantee the rights and dignity of a citizen and former head of state.
