Magistrate Faal Strikes Out SRN Steels vs. IGP Case in Kanifing Court

Magistrate Mben Faal of the Kanifing Magistrate Court made a decisive ruling on Tuesday, striking out a civil case pitting Sanjay Kumar Sharma, CEO of SRN Steels Ltd in Kitty, against the Inspector General of Police (IGP). The case, which had drawn attention due to allegations of theft involving oxygen cylinders, was formally withdrawn following a notice from the IGP.

Police Prosecutor Samba Jawo informed the court that the IGP had filed a notice to discontinue the case after Banjul Oxygen, the complainant, agreed to withdraw its claims. In her ruling, Magistrate Faal stated, “The court has granted the application filed by the IGP to strike out the case,” emphasizing that the decision served the interests of both parties and left the court with no alternative but to dismiss the matter.

The case originated from a dispute in August 2022, when Sanjay Kumar Sharma, a prominent Indian businessman, was accused of stealing 19 oxygen cylinders valued at D161,000 from Banjul Oxygen Company. Sharma, a long-time business associate of the company, consistently denied the allegations. The Gambia Police Force’s Criminal Investigation Department (CID) launched an investigation following complaints from Banjul Oxygen, leading to a search at SRN Steels Factory in Kitty Village, Kombo Central District. During the operation, authorities recovered 121 oxygen cylinders allegedly belonging to Banjul Oxygen, which were subsequently transferred to Brikama Police Station.

The striking out of the case marks the end of a legal saga that had spotlighted tensions between the two business entities. With the matter now resolved outside the courtroom, both SRN Steels and Banjul Oxygen appear poised to move forward, leaving the allegations of theft behind.
